Chapter 1 Payment of compensation, etc.

1. If a traveler participating in an organized tour conducted by our company suffers a physical injury due to a sudden and accidental external accident (hereinafter referred to as an "accident") while participating in the planned tour, the Company shall Pursuant to the provisions of this chapter to Chapter 4, we will pay compensation for death, compensation for residual disability, hospitalization solatium, and hospital visitation solatium (hereinafter referred to as "compensation money, etc.") to the traveler or his legal heir.
2. The injuries mentioned in the preceding paragraph include poisonous symptoms that suddenly occur when a toxic gas or substance is accidentally inhaled, absorbed, or ingested from outside the body (excluding poisonous symptoms that occur as a result of continuous inhalation, absorption, or ingestion). ). However, this does not include bacterial food poisoning.
1. In these regulations, "Organized travel" refers to those stipulated in Article 2, Paragraph 1 of the Standard Travel Agency Terms and Conditions of the Recruitment Type Organized Travel Contract Section and Article 2, Paragraph 1 of the Made-to-Order Type Organized Travel Contract Section.
2. In these regulations, "participating in an organized tour" refers to the first transportation/accommodation facility, etc. specified in the planned tour itinerary provided by the traveler with tickets, etc. arranged in advance by the Company for the purpose of participating in the organized tour. This refers to the period from the time you start receiving services to the time you complete receiving services such as transportation and accommodation facilities. However, if a traveler withdraws from a pre-determined planned itinerary and has notified the Company in advance of the scheduled date and time of withdrawal and return, the period from the time of withdrawal to the scheduled time of return shall be In addition, if a traveler leaves the Company without notifying the Company of the scheduled date and time of withdrawal and return, or leaves without a plan to return, the traveler shall be responsible for the period from the time of withdrawal to the time of return or thereafter. From the time you withdraw, you will no longer be considered as ``participating in an organized trip.'' In addition, if the planned itinerary includes a date on which the traveler will not receive any transportation, accommodation, etc. services arranged by our company (depending on the standard time of the travel destination), we will also provide a statement to that effect and the relevant date. If it is clearly stated in the contract document that compensation and solatium money will not be paid in accordance with these regulations for damages sustained by the traveler due to an accident that occurred on a day, the said day will not be considered as ``participating in an organized tour.'' not.
3. The term "when you start receiving services" in the preceding paragraph means any of the following times.
(1) When the reception is completed by a tour conductor, an employee of our company, or an agent, upon completion of the reception.
4. In the event that the reception mentioned in the previous item is not carried out, the first transportation/accommodation facility, etc.
(a) In the case of an aircraft, upon completion of baggage inspection etc. at the airport premises where only passengers can enter.
(b) In the case of a ship, upon completion of boarding procedures
(c) If it is a railway, at the end of the ticket gate, or if there is no ticket gate, at the time of boarding the train.
(d) When riding in a vehicle,
(e) If it is an accommodation facility, at the time of entry to the facility.
(f) If the facility is a facility other than an accommodation facility, it shall be the time when the procedures for using the facility are completed.
4. "When the provision of services is completed" in Paragraph 2 means any of the following times.
(a) If a tour conductor, employee or agent of our company announces dissolution, at the time of such announcement;
(b) In the event that the notice of dissolution referred to in the previous item is not given, the last transportation/accommodation facility, etc.
(c) In the case of an aircraft, when exiting from the airport premises where only passengers can enter.
(b) If it is a ship, at the time of disembarkation
(e) If it is a railway, at the end of the ticket gate, or if there is no ticket gate, at the time of getting off the train.
(f) When getting off the vehicle if it is a vehicle.
(g) If it is an accommodation facility, when leaving the facility.

Chapter 2 Cases where compensation, etc. is not paid

1.Our company will not pay compensation, etc. for injuries caused by the reasons listed in the following items.  
(1)The traveler's intention. However, this does not apply to injuries sustained by persons other than the traveler.
(2) Intention of the person who should receive the death compensation. However, if that person is the beneficiary of a portion of the death compensation, this shall not apply to the amount that other persons should receive.
(3) Suicidal, criminal, or combative acts by the traveler. However, this does not apply to injuries sustained by persons other than the traveler.
(4) Accidents that occur while the traveler is driving a motor vehicle or motorized bicycle without having the driving qualifications required by law, or in a state where there is a risk that the traveler may be unable to drive normally due to intoxication. However, this does not apply to injuries sustained by persons other than the traveler.
(5) Accidents that occur while a traveler intentionally engages in an act that violates the law or receives a service that violates the law. However, this does not apply to damages sustained by persons other than the traveler.
(6) Brain disease, illness or insanity of the traveler. However, this does not apply to injuries sustained by persons other than the traveler.
(7) Traveler's pregnancy, childbirth, premature birth, miscarriage, surgical operation, or other medical treatment. However, this does not apply when treating injuries that should be covered by our company.
(8) Accidents that occur during the execution of a traveler's sentence, detention, or incarceration.
(9) War, use of force by a foreign country, revolution, seizure of power, civil war, armed rebellion, and other similar incidents or riots (in this regulation, the actions of a crowd or a large group of people cause significant damage to the nation or some areas). (This refers to a situation in which the peace is disrupted and is recognized as a serious situation in terms of maintaining public order.)
(10) Radioactivity, explosiveness, or other harmful properties of nuclear fuel materials (including spent fuel; the same shall apply hereinafter) or items contaminated by nuclear fuel materials (including nuclear fission products), or due to these properties. accident
(11)Accidents that occur in conjunction with the reasons set forth in the preceding two items or accidents that occur due to disorder associated with these.

2. Regardless of the cause, our company will not pay compensation for neck syndrome (so-called "whiplash") or lower back pain with no objective symptoms.
In the case of organized tours for the purpose of domestic travel, in addition to the provisions of the preceding article, the Company will not pay compensation, etc. for injuries caused by the reasons listed in the following items.
(1) Earthquake, eruption or tsunami
(2) Accidents that occur in conjunction with the reasons set forth in the preceding item or accidents that occur due to disorder associated with these.
Our company will not pay compensation, etc. for any of the injuries listed in the following items unless the acts listed in each item are included in the itinerary of a planned tour determined in advance by our company. However, if the acts listed in each item are included in the itinerary, compensation, etc. will be paid for any injury caused by the same act while participating in a planned tour outside the itinerary.
(1) Injuries caused while the traveler was performing the exercises specified in Attached Table 1.
(2) Occurrence occurs while the traveler is engaged in competition, competition, performance (all of which include practice), or test drive (referring to driving or maneuvering for the purpose of performance testing) using a motor vehicle, motorized bicycle, or motor boat. injury. However, compensation will be paid for injuries sustained while performing these activities on the road using a car or motorized bicycle, even if the injury is not included in the itinerary of the planned tour.
(3) Injury that occurs while the traveler is operating an aircraft other than the aircraft operated by the air transport operator on a set route (regardless of whether it is a scheduled flight or an irregular flight).
(Case where compensation, etc. is not paid - Part 4)
Article 5-2 Our company may not pay compensation, etc. if the traveler or the person who should receive death compensation falls under any of the following items. However, if that person is the beneficiary of a portion of the death compensation, this shall not apply to the amount that other persons should receive.
(1) Organized crime groups, organized crime members, associate members of organized crime groups, companies affiliated with organized crime groups, and other

Chapter 3 Types of compensation, etc. and amount paid

If a traveler sustains an injury under Article 1 and dies as a direct result of the injury within 180 days from the date of the accident, the Company will 25 million yen will be paid to the traveler's legal heirs as death compensation, and 15 million yen (hereinafter referred to as the "Compensation Amount") for planned trips for domestic travel purposes. However, if there is residual disability compensation already paid for the traveler, the remaining amount will be paid after deducting the amount already paid from the compensation amount.
1. If a traveler suffers an injury under Article 1, and as a direct result of the injury, the Company shall, within 180 days from the date of the accident, recover from residual disability (serious impairment of function that remains in the body and cannot be recovered even in the future). In the event of a loss of a part of the body after the injury that caused it has healed (the same shall apply hereinafter), the compensation amount will be added to the compensation amount in Appendix 2 for each traveler. The amount multiplied by the percentage listed in each item will be paid to the traveler as residual disability compensation.
2. Notwithstanding the provisions of the preceding paragraph, if the Traveler is still in a condition that requires medical treatment more than 180 days after the date of the accident, the Company shall provide medical advice for diagnosis by a doctor on the 181st day from the date of the accident. Based on this, we will certify the degree of residual disability and pay compensation for residual disability.
3. For residual disabilities not listed in each item of Attached Table 2, regardless of the traveler's occupation, age, social status, etc., the treatment shall be applied according to the degree of physical disability and according to each item of Attached Table 2. The amount of residual disability compensation will be determined according to the classification. However, compensation for residual disabilities will not be paid for disabilities that do not result in functional impairment listed in 1(3), 1(4), 2(3), 4(4), and 5(2) of Appended Table 2. yeah.
4. If two or more types of after-effects occur due to the same accident, the Company will apply the preceding three paragraphs to each of them and pay the total amount. However, for aftereffects of the upper extremities (arms and hands) or lower extremities (legs and feet) specified in Appended Table 2, 7, 8, and 9, the aftereffect compensation for each limb shall be 60% of the compensation amount. 5. The amount of residual disability compensation to be paid by the Company based on each of the preceding paragraphs shall be limited to the compensation amount per traveler per planned trip.

Even if the traveler is not hospitalized, if he or she falls under any of the items in Attached Table 3 and receives treatment from a doctor, he or she will not be hospitalized for the period in which he or she remains in that condition under the provisions of the preceding paragraph. 3. If the Company is required to pay hospitalization souvenir money and death compensation money or hospitalization souvenir money and residual disability compensation money for one traveler, the Company will pay the total amount.
1. In the event that a traveler suffers an injury under Article 1, and as a direct result, is unable to engage in normal work or live a normal life, and requires hospital treatment (treatment by a doctor, Refers to the number of days (hereinafter referred to as "days of hospital visits") in which a person attends a hospital or clinic and receives treatment from a doctor (including house calls; the same shall apply hereinafter in this article). 3. The Company will not pay solatiums for hospital visits after the injury has healed to the extent that it does not interfere with normal work or normal life.
4. Under no circumstances will the Company pay solatium money for hospital visits after 180 days have passed from the date of the accident.
5. If the Company is required to pay a solatium for hospital visit and death compensation or a solatium for hospital visit and residual disability compensation for one traveler, the Company will pay the total amount.
Notwithstanding the provisions of the preceding two articles, if the number of hospitalization days and outpatient days for a traveler is one day or more, the Company shall pay the greater of the solatiums listed in the following items (same amount). In this case, only the amount listed in item 1) will be paid.
1. Hospitalization solatium to be paid by the Company for the relevant hospitalization days
2. The number of days of hospitalization (excluding those during the period during which the Company should pay hospitalization solatium) and the number of days of hospitalization shall be considered as the number of days of hospitalization, and the amount of hospitalization solatium that the Company should pay for the number of days concerned.
(Presumption of death)
Article 11 If the traveler is not found even after 30 days have passed since the aircraft or ship on which the traveler boarded went missing or was lost, the aircraft or ship is considered missing. It is presumed that the traveler died as a result of the injury set forth in Article 1 on the day of the accident or the day of the accident.
(Effects of other physical disabilities or diseases)
Article 12: Due to the influence of a physical disability or disease that already existed when the traveler sustained the injury under Article 1, or after the traveler suffered the injury under Article 1, the injury occurred without regard to the accident that caused it. If the injury described in Article 1 becomes serious due to the effects of injury or illness, we will determine and pay the amount equivalent to what it would be if there had been no such effect.
If the traveler has not been found even after 30 days have passed since the aircraft or ship on which the traveler boarded went missing or was in distress, the date on which the aircraft or ship went missing or was in distress; It is presumed that the traveler died as a result of the injury set forth in Article 1 on the day of the accident.
Injury or illness that occurs due to the effects of a physical disability or illness that already existed when the traveler sustained the injury under Article 1, or that occurs after the traveler has sustained the injury under Article 1 and is unrelated to the accident that caused it. If the injury described in Article 1 becomes serious due to the influence, the amount equivalent to the amount that would be paid if there were no such influence will be determined and paid.
Chapter 4 Procedures for the occurrence of accidents and claims for compensation, etc.

1. When a traveler suffers an injury under Article 1, the Company shall request an explanation from the traveler or the person who should receive the death compensation regarding the extent of the injury, the outline of the accident that caused it, or We may request a medical examination of the traveler's body or an autopsy of the body. In this case, the traveler or the person who should receive death compensation must cooperate with these requests.
2. If the traveler or the person who should receive death compensation has sustained the injury set forth in Article 1 due to reasons not related to the Company, the traveler or the person who should receive the death compensation shall inform the Company of the extent of the injury, the outline of the accident that caused it, etc. The report must be made within 30 days from the date of the accident.
3. When the traveler or the person who should receive the death compensation violates the provisions of the preceding two paragraphs without a justifiable reason recognized by the Company, or fails to explain or report the facts that he or she knows, or makes a false statement. In such cases, the Company will not pay compensation, etc.
1. When a traveler or a person who should receive death compensation pays for compensation, etc., the traveler or the person who should receive the death compensation must submit to the Company the claim form for compensation, etc. prescribed by the Company and the following documents. .
(1) In the case of a death compensation claim
A. Copy of the traveler's family register and legal heir's family register and seal impression certificate

2. The Company may request the submission of documents other than those specified in the preceding paragraph, or may permit the omission of some of the documents to be submitted in the preceding paragraph.
3. If the traveler or the person who should receive the death compensation violates the provisions of paragraph 1, does not disclose the fact that he or she knows about the submitted documents, or misrepresents the facts, the Company shall not refund the compensation, etc. I don't pay.
Even if the Company pays compensation, etc., the right to claim compensation for damages held by the Traveler or his/her heir against a third party for the injury sustained by the Traveler will not be transferred to the Company.
Chapter 5 Compensation for damage to personal effects

The Company shall pay damages to personal items (hereinafter referred to as "Indemnified Items") owned by a traveler participating in an organized tour conducted by the Company due to an accidental accident that occurs while participating in the planned tour. In some cases, compensation for damage to personal effects (hereinafter referred to as "damage compensation") will be paid pursuant to the provisions of this chapter.
1.Our company will not pay compensation for damages caused by the reasons listed in the following items.
(1)The traveler's intention. However, this does not apply to damages sustained by persons other than the traveler.
(2) Intentionally caused by a relative living in the same household as the traveler. However, this does not apply if the purpose is not to have the traveler receive compensation for damages.
(3) Suicidal, criminal, or combative acts by the traveler. However, this does not apply to damages sustained by persons other than the traveler.
(4) Accidents that occur while the traveler is driving a motor vehicle or motorized bicycle without having the driving qualifications required by law, or in a state where there is a risk that the traveler may be unable to drive normally due to intoxication. However, this does not apply to damages sustained by persons other than the traveler.
(5) Accidents that occur while a traveler intentionally engages in an act that violates the law or receives a service that violates the law. However, this does not apply to damages sustained by persons other than the traveler.
(6) Exercise of public authority by the state or public entity, such as seizure, requisition, confiscation, destruction, etc. However, this excludes cases where the measures are necessary for fire extinguishing or evacuation.
(7) Defects in products covered by compensation. However, this excludes defects that could not have been discovered even with due care by the Traveler or the person managing the Compensable Goods on his or her behalf.
(8) Natural wear and tear, rust, mold, discoloration, rat-eaten, moth-eaten, etc. of covered items.
(9) Damage that is merely cosmetic damage that does not interfere with the functionality of the product covered by compensation.
(10) Spillage of liquid that is covered by compensation. However, this does not apply to damage caused to other products covered by compensation as a result.
(11) Misplacing or losing items covered by compensation
(12) The grounds listed in Article 3, Paragraph 1, Items 9 to 12
2. In the case of organized travel for the purpose of domestic travel, in addition to the provisions set forth in the preceding paragraph, the Company will not pay compensation for damages caused by the reasons listed in the following items.
(1) Earthquake, eruption or tsunami
(2) Accidents that occur in conjunction with the reasons set forth in the preceding item or accidents that occur due to disorder associated with these.
1. Our company may not pay compensation for damages if the traveler falls under any of the following items.
(1) It is recognized that the person falls under an anti-social force.
(2) It is recognized that the person is involved in providing funds, etc. or providing convenience to anti-social forces.
(3) It is recognized that the person is making unfair use of anti-social forces.
(4) In the case of a corporation, it is recognized that anti-social forces control the corporation or are substantially involved in the management of the corporation.
(5) It is recognized that the person has a socially reprehensible relationship with other anti-social forces.
1. Items eligible for compensation are limited to personal items owned by the traveler and carried while participating in an organized tour.
2. Notwithstanding the provisions of the preceding paragraph, the items listed below are not included in the products eligible for compensation.
(1) Cash, checks and other securities, stamps, stamps and other similar items.
(2) Credit cards, coupons, airline tickets, passports, and other similar items.
(3) Recording media that can be directly processed by information equipment (computers and their peripheral equipment such as terminal devices) such as manuscripts, design documents, designs, ledgers, and other similar items (magnetic tapes, magnetic disks, CD-ROMs, optical disks, etc.) (Including those recorded in )
(4) Ships (including yachts, motorboats, and boats), automobiles, motorized bicycles, and their accessories.
(5) Mountain climbing equipment, exploration equipment and other similar items.
(6) Dentures, artificial limbs, contact lenses and other similar items
(7) Animals and plants
(8) Other items specified by our company in advance.
1. The amount of damages for which the Company is to pay compensation (hereinafter referred to as the "damage amount") shall be the value of the compensated item at the place and time when the damage occurred, or the condition of the compensated item immediately before the damage occurred. The amount shall be determined based on the lower of the total amount of repair costs necessary to restore the property and the costs set forth in Paragraph 3 of the following article.
2. If the amount of damage to one or a pair of Compensable Items exceeds 100,000 yen, the Company will apply the provisions of the preceding paragraph, deeming the amount of damage to that item to be 100,000 yen.
3. The amount of compensation for damages to be paid by the Company shall be limited to 150,000 yen per traveler per planned trip. However, if the amount of damage does not exceed 3,000 yen per traveler per accident, our company will not pay compensation for damage.
1. When a traveler learns that damage stipulated in Article 16 has occurred with respect to a product eligible for compensation, the traveler must perform the following:
(1) Make efforts to prevent and reduce damage.
(2) Notify the Company without delay of the extent of the damage, the outline of the accident that caused it, and whether or not there is an insurance contract for the covered items for which the Traveler sustained damage.
(3) If the traveler is entitled to receive compensation for damages from another person, take the necessary procedures to exercise that right.
2. If a traveler violates item 1 of the preceding paragraph without justifiable reason, the Company will deduct the amount that could have been prevented and reduced as the amount remaining as the amount of damage, and the traveler will violate item 2 of the same paragraph. If compensation for damages is not paid, and if item 3 of the same paragraph is violated, the amount remaining after subtracting the amount that is deemed to have been received through the exercise of the rights to be acquired shall be deemed to be the amount of damages.
3. The Company will pay the following expenses.
(1) Among the costs required to prevent and reduce the damage prescribed in Paragraph 1, Item 1, the Company deems it necessary or beneficial.
(2) Expenses necessary for the procedures prescribed in paragraph 1, item 3.
1. When a traveler wishes to receive compensation for damages, he or she must submit to the Company the claim form for compensation for damages prescribed by the Company and the following documents.  
(1) Accident certificate from a police station or a third party that should replace it.
(2) Documents certifying the extent of damage to the item covered by compensation.
(3) Other documents requested by our company
2. When the traveler violates the provisions of the preceding paragraph, or intentionally misrepresents the submitted documents, or forges or alters the documents (the same shall apply when the traveler causes a third party to do so). ), our company will not pay compensation for damages.
If there is an insurance contract that requires insurance claims to be paid for damages set forth in Article 16, the Company may reduce the amount of damage compensation to be paid by the Company.
